Advance Notice on Draft Amendment to Article 3 of the Regulations Governing the Applicable Scope of Special Circumstances for the Public Announcement and Filing of Financial Reports and Operational Status Reports by Public Companies

Considering that the process of calculating the insurance revenues is more complicated than the current one after adopting IFRS 17 Insurance Contracts starting from FY 2026, and there is a possibility that the insurance enterprise may not have enough time to make a public announcement, in order to ensure the accuracy of the announcement regarding the operating revenues and the effectiveness for investors to obtain the information, the Financial Supervisory Commission (hereinafter referred to as “FSC”) has proposed an amendment to Article 3 of the Regulations Governing the Applicable Scope of Special Circumstances for the Public Announcement and Filing of Financial Reports and Operational Status Reports by Public Companies. The amendment provides that starting from FY 2026, if the insurance enterprise or public company with insurance subsidiary is unable to meet the deadline to publicly announce and file its consolidated operating revenue for the previous month by the 10th day of each month, the deadline may be extended to the 15th day of each month. The insurance enterprise stated in the preceding paragraph includes life insurance, property insurance, and reinsurance enterprises, excluding insurance brokers and agents.
According to the FSC, in order to consider the opinions of stakeholders to make the amendments more comprehensive, in addition to being published in the official gazette of the Executive Yuan, the general description of the draft and a comparison table of the amended articles will be published on the FSC website for public consultation.
